Sexual Predator/Offender Registry
Title I of the Adam Walsh Child Protection and Safety Act of 2006 (PL 109-248), the Sex Offender Registration and Notification Act (S.O.R.N.A.), was signed into law on July 27, 2006. The Act expands the National Sex Offender Registry. It requires that all states and tribes that decided to “opt in” participate in an integrated, uniform registry system. All law enforcement will have access to the same information across the United States, helping prevent sex offenders from evading detection by moving from state to state, reservation to state, state to reservation and/or reservation to reservation.
The Seminole Tribal Council passed resolution No. C-130-13,which authorized the Tribe to enter into a Memorandum of Agreement (M.O.A.) with the Florida Department of Law Enforcement (F.D.L.E.) and various Florida Sheriffs' Offices. The M.O.A. enables the Tribe to utilize the State of Florida's sex offender registry database, public website, and public email notification system in order to implement the requirements of the S.O.R.N.A. in the Tribe's jurisdiction. That resolution also explicitly preserved the Tribe's status and authority as a registration jurisdiction under the S.O.R.N.A., and adopted as Tribal Law the substantive sexual offender registration requirements found in Florida State Statutes 775.21, 775.25, 943.0435, and 985.4815 as codified on the date of the adoption of the resolution.
This M.O.A. that the Seminole Tribe of Florida has entered into implements an effective system of resource sharing, information sharing, and intergovernmental cooperation. The M.O.A. was written and enacted in a manner that fully protects the sovereign interests and status of the Seminole Tribe of Florida.
Under the M.O.A., the Seminole Police Department is granted access to the State of Florida's sexual predator/offender registry database in the same manner as local law enforcement in the State of Florida, and may use the registry database in the implementation of the S.O.R.N.A. Because the State and the Tribe utilize the same database, each jurisdiction is immediately notified of any entry of new or updated data by the other jurisdiction.
The M.O.A. provides for the State of Florida to be responsible for initial registration and periodic re-registration as required by law of all sexual predators/offenders required to register within State or Tribal jurisdictions. The M.O.A. also provides for the Seminole Police Department to have the authority to conduct house checks of any sexual predators/offenders living or staying on Seminole Reservations and to conduct investigation(s) of any violation of the S.O.R.N.A. occurring on Seminole Reservations. Furthermore, the Seminole Police Department is responsible for certain community notification activities. A door-to-door notification of businesses and residences by the Seminole Police Department will be completed when either a sexual predator or a sexual offender resides and/or moves into any Reservation Community.
Under the Florida sexual predator statute the Florida Department of Corrections or the local jail with custody of a sexual predator/offender is responsible for initial registration of the sexual predator/offender with F.D.L.E. The Department of Corrections is responsible for initial registration of any sexual predator/offender in the custody of a private correctional facility within the State as well. If a sexual predator/offender who is required to be registered establishes or maintains a residence in Florida and is not in the custody or control of the Department of Corrections, a local jail, or a private correctional facility, the sexual predator/offender is required to register in person at the Sheriff's Office in the county in which the predator/offender establishes or maintains a permanent or temporary residence. See Florida State Statute 775.21 and 943.0435 respectively.
